This Photo & Video Policy (“Policy”) explains how Sapphire Sky Events LLC, a Georgia limited liability company (“Sapphire Sky Events,” “Company,” “we,” “us,” or “our”), may create, receive, store, edit, publish, distribute, and otherwise use photographs, videos, audio recordings, and other event-related media.
This Policy applies when expressly incorporated into a Wedding & Event Décor Agreement, Rental Agreement, proposal, Event Service Schedule, booking confirmation, or other signed agreement between Sapphire Sky Events and the person or persons identified as the client (“Client,” “you,” or “your”).
Merely viewing this Policy on the Company’s website does not grant Sapphire Sky Events permission to use an identifiable person’s name, image, voice, appearance, or likeness for marketing. The applicable authorization is granted through the Client’s signature on a Client Agreement that contains the Photo and Video Marketing Authorization and incorporates this Policy.
1. Relationship to the Client Agreement
This Policy forms part of the Client Agreement when the signed agreement identifies and incorporates:
Photo & Video Policy, Version 1.0, effective July 13, 2026.
The complete Client Agreement may include:
-
The accepted proposal or Event Service Schedule;
-
The Wedding & Event Décor Agreement or Rental Agreement;
-
The Photo and Video Marketing Authorization contained in that signed agreement;
-
This Policy;
-
The Privacy Policy;
-
The General Client Terms;
-
Approved written change orders; and
-
Other documents expressly identified as part of the booking.
If this Policy conflicts with a more specific, separately signed media or confidentiality agreement, the more specific signed agreement will control.
2. Purpose of Event Media
Sapphire Sky Events may create or receive Event-related Media for purposes including:
-
Documenting décor and Event design;
-
Recording delivery, installation, and breakdown;
-
Confirming Rental Property condition;
-
Recording equipment placement and operation;
-
Supporting safety and quality control;
-
Addressing damage, payment, insurance, or legal disputes;
-
Maintaining business records;
-
Creating Company portfolios;
-
Advertising Company services;
-
Publishing social-media content;
-
Collaborating with authorized Event vendors and Venues;
-
Submitting work for industry publications or awards;
-
Providing photo-booth or gallery services; and
-
Other lawful business purposes described in this Policy.
Different rules may apply to internal operational documentation and public marketing use.
3. Definition of Media
For purposes of this Policy, “Media” may include:
-
Photographs;
-
Video recordings;
-
Audio recordings;
-
Reels;
-
Short-form videos;
-
Time-lapse recordings;
-
Behind-the-scenes content;
-
Photo-booth images;
-
GIFs;
-
Boomerangs;
-
Digital photo strips;
-
Screenshots;
-
Edited compilations;
-
Social-media content;
-
Digital galleries;
-
Images supplied by the Client;
-
Images supplied by photographers, videographers, Venues, or vendors;
-
Lawfully supplied drone footage; and
-
Other visual, audio, or audiovisual Event content.
4. Marketing Authorization Through the Signed Client Agreement
The Client grants the Photo and Video Marketing Authorization by signing a Wedding & Event Décor Agreement, Rental Agreement, or other Client Agreement that:
-
Contains the Photo and Video Marketing Authorization;
-
Expressly incorporates this Policy;
-
Identifies this Policy by title, version, and effective date; and
-
Is signed or electronically accepted by the Client.
No separate media checkbox, initials, release form, or additional signature is required when the authorization is clearly stated within the signed Client Agreement.
By signing the applicable Client Agreement, each signing adult Client authorizes Sapphire Sky Events to photograph and record the Event and to use Media intentionally featuring that signing Client’s:

Name;
-
Image;
-
Voice;
-
Appearance;
-
Likeness;
-
Statements;
-
Event participation; and
-
Interaction with Company décor, rentals, equipment, personnel, or services.
The authorization is worldwide, royalty-free, nonexclusive, and continuing for the lawful marketing and business purposes described in this Policy.
Unless Sapphire Sky Events approves a written exception, the Photo and Video Marketing Authorization is part of the terms of the applicable booking.
5. Authorization Is Limited to Each Signing Adult
Each adult Client grants authorization only for that Client’s own:

Name;
-
Image;
-
Voice;
-
Appearance;
-
Likeness;
-
Statements; and
-
Personal Event participation.
One Client does not automatically have authority to grant identifiable marketing permission on behalf of:
-
Another adult Client;
-
A spouse or fiancé who did not sign;
-
Adult family members;
-
Bridesmaids or groomsmen;
-
Adult guests;
-
Venue employees;
-
Planners;
-
Vendors;
-
Performers;
-
Photographers;
-
Entertainers; or
-
Other adult attendees.
When two or more adults sign the Client Agreement, each adult’s signature grants authorization only for that signing adult.
If Sapphire Sky Events intends to intentionally feature two adult Clients, both adults should sign the applicable Client Agreement or provide separate written authorization.
Sapphire Sky Events may request separate written or electronic permission before intentionally featuring another identifiable adult in Company advertising.
6. Authorized Marketing and Business Uses
Subject to the signed Client Agreement and this Policy, Sapphire Sky Events may use authorized Media for:

The Company website;
-
Online portfolios;
-
Printed portfolios;
-
Instagram posts, Stories, and Reels;
-
Facebook posts and advertisements;
-
TikTok and similar platforms;
-
Other Company social-media accounts;
-
Digital advertisements;
-
Search and display advertisements;
-
Printed advertisements;
-
Brochures;
-
Proposals;
-
Lookbooks;
-
Promotional videos;
-
Sales presentations;
-
Trade-show displays;
-
Venue collaborations;
-
Vendor collaborations;
-
Industry publications;
-
Public-relations materials;
-
Professional award submissions;
-
Educational materials;
-
Behind-the-scenes content;
-
Internal Company training; and
-
Other lawful promotion of Sapphire Sky Events and its services.
7. Décor, Venue, and Service Media
Sapphire Sky Events may photograph or record:
-
Ceremony décor;
-
Reception décor;
-
Floral arrangements;
-
Centerpieces;
-
Tablescapes;
-
Arches;
-
Backdrops;
-
Draping;
-
Dance floors;
-
Furniture;
-
Candles;
-
Signage;
-
Seating charts;
-
Welcome displays;
-
Photo booths;
-
Special Effects;
-
Lighting;
-
Rental Property;
-
Venue spaces;
-
Installation details;
-
Completed room designs;
-
Setup;
-
Breakdown; and
-
Other products or services supplied by the Company.
Décor-focused Media may include:
-
Empty-room photographs;
-
Close-up décor details;
-
Wide-angle room views;
-
Before-and-after content;
-
Installation footage;
-
Event atmosphere; and
-
Incidental background appearances by attendees.
Sapphire Sky Events will use reasonable judgment when deciding whether a person who did not provide authorization is too prominently identifiable for commercial marketing use.
8. Operational Documentation
Regardless of public marketing use, Sapphire Sky Events may create and retain reasonable operational documentation showing:

Venue condition;
-
Delivery;
-
Loading and unloading;
-
Installation progress;
-
Completed placement;
-
Rental Property condition;
-
Equipment location;
-
Electrical connections;
-
Safety clearances;
-
Special-Effects operation;
-
Venue restrictions;
-
Damage;
-
Missing property;
-
Guest or vendor interference;
-
Breakdown;
-
Pickup;
-
Customer-pickup returns; and
-
Other matters reasonably related to performance of the Client Agreement.
Operational documentation may be used for:
-
Internal business records;
-
Quality control;
-
Employee or contractor training;
-
Safety review;
-
Rental inventory management;
-
Insurance claims;
-
Damage claims;
-
Payment disputes;
-
Chargebacks;
-
Venue disputes;
-
Legal proceedings;
-
Governmental requests;
-
Enforcement of the Client Agreement; and
-
Protection of the Company, Client, guests, Venue, and property.
Operational documentation does not require separate marketing authorization when it is used only for legitimate internal, contractual, safety, insurance, security, or legal purposes.
9. Guests and Other Attendees
The Client should notify Sapphire Sky Events before the Event when:
-
The Event is private or confidential;
-
A guest has a material privacy restriction;
-
A protected person may attend;
-
A court order affects photography;
-
A public official, celebrity, or security-sensitive person may attend;
-
A cultural or religious photography restriction applies;
-
A guest has specifically requested not to be photographed; or
-
Another serious privacy or safety concern exists.
The Company will make reasonable efforts to avoid intentionally featuring an identified restricted person.
However, Sapphire Sky Events cannot guarantee that a person will never appear incidentally in:
-
Wide room photographs;
-
Crowd footage;
-
Dance-floor footage;
-
Special-Effects footage;
-
Photo-booth areas;
-
Background activity;
-
Installation documentation; or
-
General Event atmosphere.
A general photography notice may inform attendees that photography or recording is taking place, but it does not automatically replace individual permission for intentional close-up commercial use where separate authorization is appropriate.
10. Minors
A parent or legal guardian must authorize intentional identifiable marketing use of a minor.
A Client may provide authorization for a minor only when the Client:
-
Is the minor’s parent;
-
Is the minor’s legal guardian; or
-
Has documented legal authority to provide the authorization.
Sapphire Sky Events may request a separate Minor Photo and Video Authorization before intentionally featuring a minor in:
-
Close-up photographs;
-
Promotional videos;
-
Advertisements;
-
Social-media collaborations;
-
Testimonials; or
-
Other identifiable marketing content.
Without appropriate authorization, Sapphire Sky Events will make reasonable efforts not to intentionally feature an identifiable minor in public marketing.
A minor may appear incidentally in a wide room, crowd, décor, Special-Effects, or atmosphere image. Sapphire Sky Events will not ordinarily identify the minor by name without appropriate parent or guardian authorization.
11. Private and Confidential Events
A Client requiring heightened confidentiality must notify Sapphire Sky Events in writing before signing the Client Agreement and request a specific written confidentiality exception.
Examples may include:
-
Events held at private residences;
-
Security-sensitive attendees;
-
High-profile individuals;
-
Confidential corporate events;
-
Protected family circumstances;
-
Cultural or religious restrictions; or
-
Events subject to separate nondisclosure obligations.
Unless Sapphire Sky Events accepts a written confidentiality exception, the Photo and Video Marketing Authorization contained in the signed Client Agreement and this Policy will govern the Company’s use of Media.
Sapphire Sky Events may decline a booking when requested confidentiality restrictions materially conflict with the Client Agreement, legitimate operational documentation needs, or the Company’s business requirements.
12. Media Created by Sapphire Sky Events
Media created by Sapphire Sky Events employees or authorized contractors may be owned or licensed by Sapphire Sky Events, depending on the applicable employment, contractor, or licensing arrangement.
When Sapphire Sky Events owns or has permission to use the Media, the Company may exercise the uses authorized by the signed Client Agreement and this Policy.
The Client does not receive copyright ownership in Company-created Media merely because:

The Media was created at the Client’s Event;
-
The Client appears in the Media;
-
The Client paid for Event services; or
-
The Client receives a copy.
Any copyright sale, assignment, or exclusive license must be stated in a separate written agreement.
13. Professional Photographer and Videographer Rights
Permission to use a person’s name, image, voice, or likeness is separate from copyright ownership of the photograph or video.
Professional Event Media may be owned by:
-
The photographer;
-
Videographer;
-
Photography studio;
-
Videography company;
-
Employer;
-
Commissioning party;
-
Sapphire Sky Events; or
-
Another copyright owner.
Sapphire Sky Events will use professional Media only when the Company:
-
Owns the Media;
-
Has received permission from the copyright owner;
-
Has a valid license;
-
Received the Media from a person with authority to authorize the intended use; or
-
Is otherwise legally permitted to use it.
The Client’s signature and likeness authorization do not automatically transfer a photographer’s or videographer’s copyright to Sapphire Sky Events.
Similarly, copyright permission from a photographer does not replace any permission required from an identifiable person appearing in the Media.
14. Media Supplied by the Client
When the Client sends, uploads, shares, or otherwise provides Media to Sapphire Sky Events for possible use, the Client represents that:

The Client has authority to provide the Media;
-
The intended Company use does not violate a third party’s copyright;
-
Required photographer or videographer permission has been obtained;
-
Required identifiable-person permissions have been obtained;
-
The Client has disclosed any usage restriction; and
-
The Client has disclosed any required copyright or vendor credit.
Merely tagging Sapphire Sky Events on social media does not necessarily grant unlimited advertising rights.
The Company may request additional confirmation or permission before using tagged or Client-supplied professional Media outside the original social-media context.
15. Vendor and Venue Collaborations
Sapphire Sky Events may collaborate with:
-
Photographers;
-
Videographers;
-
Venues;
-
Planners;
-
Florists;
-
Bakers;
-
DJs;
-
Rental providers;
-
Makeup artists;
-
Hair stylists;
-
Designers; and
-
Other participating Event vendors.
The Company may provide vendor credit when:
-
Credit is contractually required;
-
The copyright owner requests credit;
-
The Media was provided as part of a collaboration;
-
The source is known; or
-
Credit is professionally appropriate.
Credit does not replace the need for permission.
Sapphire Sky Events may permit authorized Venues or vendors to repost Company-created Media when the repost:
-
Relates to the Event;
-
Is consistent with the signed authorization and this Policy;
-
Does not create a false endorsement;
-
Does not exceed stated restrictions; and
-
Complies with applicable copyright requirements.
This Policy does not automatically authorize an unrelated vendor to use an identifiable person’s likeness independently for that vendor’s advertising.
16. Social-Media Collaboration and Tagging
Sapphire Sky Events may invite the Client to:
-
Accept a social-media collaboration;
-
Be tagged in a post;
-
Share a Reel;
-
Repost Event Media;
-
Provide a testimonial; or
-
Participate in promotional content.
The Client is not required to accept a separate social-media collaboration request unless a signed agreement expressly states otherwise.
Sapphire Sky Events may publish authorized Media without tagging or identifying the Client.
The Company will not ordinarily publish the Client’s private contact information.
17. Editing and Formatting
Sapphire Sky Events may edit authorized Media through ordinary production methods, including:

Cropping;
-
Resizing;
-
Color correction;
-
Lighting adjustment;
-
Retouching;
-
Audio cleanup;
-
Noise reduction;
-
Background adjustment;
-
Captioning;
-
Adding Company logos;
-
Adding text overlays;
-
Adding licensed music;
-
Sequencing clips;
-
Combining Event footage;
-
Creating short-form edits; and
-
Formatting content for different platforms.
Sapphire Sky Events will not knowingly edit Media in a materially false, defamatory, humiliating, or misleading manner.
The Company will not knowingly use Media to falsely represent that a person:
-
Made a statement they did not make;
-
Endorsed an unrelated product or company;
-
Participated in an unrelated Event;
-
Engaged in conduct that did not occur;
-
Holds a political or social position;
-
Has a medical condition; or
-
Possesses another sensitive personal characteristic.
18. Artificial Intelligence and Synthetic Media
Sapphire Sky Events may use ordinary automated or artificial-intelligence-assisted editing tools for purposes such as:
-
Image enhancement;
-
Background cleanup;
-
Removal of distracting objects;
-
Noise reduction;
-
Color correction;
-
Cropping;
-
Caption generation;
-
File organization; and
-
Formatting.
Without separate written permission, Sapphire Sky Events will not knowingly use Event Media to:
-
Create a deceptive synthetic impersonation;
-
Clone a person’s voice;
-
Fabricate speech;
-
Fabricate conduct;
-
Materially alter a person’s face or body;
-
Place an identifiable person into an unrelated artificial scene for advertising;
-
Create a facial-recognition profile;
-
Create a biometric identification template; or
-
Train a publicly available facial-recognition system.
19. Testimonials, Reviews, and Endorsements
The Photo and Video Marketing Authorization does not authorize Sapphire Sky Events to fabricate a testimonial or falsely state that the Client recommended the Company.
When a Client voluntarily provides a:
-
Review;
-
Testimonial;
-
Interview;
-
Written statement;
-
Recorded statement; or
-
Social-media comment,
Sapphire Sky Events may use it only in a manner that accurately represents the Client’s communication and experience.
The Company may correct:
-
Spelling;
-
Grammar;
-
Punctuation;
-
Length; and
-
Formatting
provided that the edit does not materially change the meaning.
Sapphire Sky Events will not knowingly:
-
Create a false review;
-
Change a negative review into a positive review;
-
Attribute a statement to someone who did not make it;
-
Use a person’s appearance as a fabricated testimonial; or
-
Imply endorsement of an unrelated product, company, political position, or social cause.
20. Photo Booths and Event Galleries
Photo-booth participation is voluntary.
Depending on the booked service, a photo booth may create:
-
Photographs;
-
Videos;
-
GIFs;
-
Boomerangs;
-
Digital strips;
-
Printed photographs; or
-
Other guest-generated content.
Participants may be offered delivery through:
-
Email;
-
Text message;
-
QR code;
-
Digital download; or
-
Private online gallery.
A Client’s signature does not automatically authorize intentional identifiable marketing use of every photo-booth guest.
Photo-booth Media featuring a person other than a signing Client may be used for marketing only when:
-
The participant gives appropriate permission;
-
A parent or legal guardian authorizes an identifiable minor;
-
The participant appears only incidentally in décor or atmosphere Media; or
-
Another lawful authorization applies.
Photo-booth data collection, digital delivery, gallery access, and retention are also governed by the Privacy Policy and any applicable photo-booth notice.
21. Special-Effects Media
Sapphire Sky Events may photograph or record the setup and operation of:
-
Cold sparks;
-
Dancing on the Clouds;
-
Fog;
-
Haze;
-
Snow effects;
-
Bubble effects;
-
Lasers;
-
Lighting effects;
-
Dance floors;
-
Photo booths; and
-
Other technical services.
Special-Effects Media may document:
-
Equipment placement;
-
Safety clearances;
-
Venue approval;
-
Technician operation;
-
Guest positioning;
-
Equipment performance;
-
Unauthorized interference;
-
Damage; and
-
Compliance with operating procedures.
Public marketing use of Media intentionally featuring a signing Client is authorized through the Client’s signature on the applicable Client Agreement.
Intentional close-up marketing use of another identifiable adult may require separate permission.
22. Privacy and Sensitive Information
Sapphire Sky Events will not knowingly publish highly sensitive information merely because it appears in Event Media.
Examples include:

Complete payment information;
-
Government identification;
-
Private telephone numbers;
-
Private email addresses;
-
Private residential addresses;
-
Medical information;
-
Security codes;
-
Confidential access instructions;
-
Private planning documents;
-
Detailed guest information; and
-
Other information creating a material privacy or security risk.
The Company may:
-
Crop the information;
-
Blur or obscure it;
-
Select another image; or
-
Decline to publish the Media.
The collection and processing of personal information are also governed by the Sapphire Sky Events Privacy Policy.
23. No Compensation
Unless a separate written agreement states otherwise, the Client is not entitled to:
-
A modeling fee;
-
Royalty;
-
Residual payment;
-
Advertising fee;
-
Licensing payment;
-
Profit participation;
-
Commission; or
-
Other compensation
for uses authorized by the Client Agreement and this Policy.
Payment for Event services does not make the Client an employee, owner, partner, or paid spokesperson of Sapphire Sky Events.
24. No Requirement to Publish
The authorization gives Sapphire Sky Events permission to use authorized Media but does not require the Company to:
-
Publish any Media;
-
Publish every photograph or video;
-
Identify or tag the Client;
-
Credit every Event vendor;
-
Provide copies to the Client;
-
Publish on a particular platform;
-
Maintain publication for a specific period; or
-
Use the Media in a particular advertising campaign.
Sapphire Sky Events may choose not to use particular Media or may remove it at any time.
25. No Prior Approval of Final Content
Sapphire Sky Events is not ordinarily required to obtain additional Client approval of:
-
The selected photograph;
-
Final video;
-
Editing;
-
Caption;
-
Layout;
-
Music;
-
Logo placement;
-
Publication date;
-
Platform;
-
Advertising format; or
-
Other finished content
when the use is within the signed authorization and this Policy.
This section does not permit:
-
False advertising;
-
Fabricated testimonials;
-
Defamatory use;
-
Materially misleading editing;
-
Copyright infringement; or
-
Use outside the authorization.
26. Removal and Future-Use Requests
A signing Client may request that Sapphire Sky Events review removal of identifiable Media or stop initiating new marketing use.
Requests must be sent to:
The email subject line should state:
Photo and Video Removal Request
The request should include:
-
The person’s full name;
-
Event Date;
-
Venue;
-
A screenshot or description of the Media;
-
The platform or location where it appears; and
-
The requested action.
Sapphire Sky Events will review reasonable requests in good faith.
Where reasonably practical, the Company may stop initiating new marketing use and remove identifiable Media from digital platforms directly controlled by Sapphire Sky Events.
Unless required by applicable law, a removal request does not require Sapphire Sky Events to:
-
Recall printed materials already produced or distributed;
-
Recover materials already provided to authorized vendors;
-
Undo advertising already completed;
-
Remove lawful reposts outside Company control;
-
Delete inaccessible backup copies immediately;
-
Remove internal operational documentation;
-
Delete insurance, legal, damage, safety, or claim records; or
-
Pay compensation for authorized use occurring before the request.
Sapphire Sky Events may require up to 30 calendar days to process an ordinary nonurgent request.
27. Guest Removal Requests
An identifiable guest may contact Sapphire Sky Events to request review of Media featuring that guest.
The Company may request information reasonably necessary to:
-
Confirm the person’s identity;
-
Locate the Media;
-
Evaluate the request;
-
Confirm whether permission was obtained;
-
Protect another person’s privacy; or
-
Confirm copyright rights.
Submitting a request does not guarantee that every copy can be removed, especially when Media has been:
-
Independently reposted;
-
Printed;
-
Archived;
-
Supplied to another authorized party; or
-
Published outside the Company’s direct control.
28. Media Retention
Sapphire Sky Events may retain Media for as long as reasonably necessary for:
-
Marketing;
-
Portfolio maintenance;
-
Client-service records;
-
Rental-condition documentation;
-
Damage documentation;
-
Insurance;
-
Safety;
-
Legal compliance;
-
Dispute resolution;
-
Backup systems;
-
Historical business records; and
-
Other legitimate business purposes.
Public marketing Media may remain in the Company’s portfolio until removed, replaced, or no longer reasonably useful.
Operational documentation may be retained longer when reasonably necessary to protect legal, insurance, safety, property, or business interests.
29. Security and Third-Party Platforms
Sapphire Sky Events uses reasonable safeguards designed to protect Media and related personal information.
However, no storage method, transmission, social-media platform, digital gallery, email service, cloud provider, or online system can be guaranteed to be completely secure.
Authorized Media may be processed through third-party services used for:

Website hosting;
-
Social-media publishing;
-
Advertising;
-
File storage;
-
Editing;
-
Gallery hosting;
-
Photo-booth delivery;
-
Email;
-
Text-message delivery;
-
Client management;
-
Printing; and
-
Other business operations.
Third-party services may process Media according to their own privacy policies and terms.
30. Third-Party Reposting and Independent Media
Sapphire Sky Events cannot fully control Media created, copied, posted, or distributed independently by:
-
Guests;
-
Clients;
-
Photographers;
-
Videographers;
-
Venues;
-
Planners;
-
DJs;
-
Vendors;
-
Social-media users; or
-
Other third parties.
Once authorized Media is lawfully posted online, other users may:
-
Share it;
-
Repost it;
-
Screenshot it;
-
Download it;
-
Embed it; or
-
Distribute it
according to platform functionality or their independent conduct.
Sapphire Sky Events is not responsible for unauthorized third-party use unless the third party was acting under the Company’s direction and within the authorized scope of its duties.
31. Client Responsibilities
The Client agrees to:
-
Review the Photo and Video Marketing Authorization before signing;
-
Sign the Client Agreement only after reviewing the authorization and this Policy;
-
Ensure that every adult intended to grant authorization signs the applicable Client Agreement or separate authorization;
-
Inform Sapphire Sky Events of material privacy restrictions;
-
Avoid granting permission for another adult without authority;
-
Obtain parent or guardian permission for an intentionally featured minor;
-
Disclose professional photographer or videographer restrictions;
-
Provide known copyright and credit information;
-
Avoid supplying Media that the Client has no authority to share;
-
Inform the Company of confidential or security-sensitive circumstances; and
-
Communicate known guest restrictions as early as reasonably possible.
The Client is not responsible for obtaining a marketing release from every Event attendee merely because Sapphire Sky Events provides services at the Event.
Sapphire Sky Events remains responsible for determining whether additional permission is appropriate before intentionally featuring a non-signing person in Company advertising.
32. Authorized Use and Client Release
By signing a Client Agreement containing the Photo and Video Marketing Authorization, the signing Client authorizes Sapphire Sky Events to use the Client’s name, image, voice, appearance, likeness, statements, and Event participation for the purposes described in this Policy.
To the fullest extent permitted by law, the signing Client releases Sapphire Sky Events and its authorized employees, contractors, marketing providers, and service providers from claims by that signing Client arising solely from authorized use within the scope of the Client Agreement and this Policy, including claims concerning:

Appropriation of likeness;

Right of privacy;
-
Right of publicity;
-
Public display;
-
Advertising use;
-
Ordinary authorized editing;
-
Failure to provide compensation; or
-
Failure to obtain additional approval of final marketing content.
This release does not apply to:

Use outside the signed authorization;
-
Copyright infringement;
-
A fabricated testimonial;
-
Materially false or defamatory use;
-
Fraud;
-
Gross negligence;
-
Willful misconduct;
-
Intentional wrongdoing; or
-
Rights that cannot legally be waived.
Nothing in this Policy waives an independent legal claim belonging to a person who did not sign an applicable authorization.
33. Relationship to the Privacy Policy
The collection, storage, use, disclosure, security, and retention of personal information associated with Media are also governed by the Sapphire Sky Events Privacy Policy.
If there is a conflict regarding personal-information processing, the Privacy Policy will control unless the signed Client Agreement provides a more specific lawful instruction.
34. Relationship to the General Client Terms
The General Client Terms govern related matters including:

Intellectual property;
-
Confidential information;
-
Indemnification;
-
Limitations of liability;
-
Claims;
-
Dispute resolution;
-
Governing law;
-
Court location;
-
Notices;
-
Electronic signatures; and
-
Other general legal matters.
This Policy should be read together with the General Client Terms and applicable signed Client Agreement.
35. Electronic Signatures and Records
The Client may grant the Photo and Video Marketing Authorization through an electronic signature on the applicable Client Agreement.
Electronic records associated with the authorization may include:

The signed Client Agreement;
-
HoneyBook or Client-portal records;
-
Signature timestamps;
-
Signer identity information;
-
Email records;
-
IP or device records, when available;
-
Audit trails; and
-
Copies delivered to the Client.
The Company should preserve a reliable copy of the signed Client Agreement and the policy version incorporated into that agreement.
36. Policy Updates
The version of this Policy incorporated into the Client’s signed booking will govern that booking.
Sapphire Sky Events may revise this Policy prospectively for future bookings.
A later website update will not retroactively expand or change an existing Client’s authorization unless the affected Client accepts the change in writing.
Sapphire Sky Events should retain a PDF or other reliable copy of the applicable version with the Client’s booking records.
