These Website Terms of Use (“Terms”) govern access to and use of the Sapphire Sky Events website, including its pages, features, forms, photographs, videos, text, graphics, downloads, and other online content (collectively, the “Website”).
The Website is owned and operated by Sapphire Sky Events LLC, a Georgia limited liability company (“Sapphire Sky Events,” “Company,” “we,” “us,” or “our”).
By accessing or using the Website, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you should not use the Website.
1. Website Use Only
These Terms govern use of the Website. They do not, by themselves, constitute an agreement for Sapphire Sky Events to provide event décor, rentals, floral design, special effects, entertainment, installation, transportation, or other event services.
All booked services are governed by the applicable:

Proposal or Event Service Schedule;

Invoice and payment schedule;

Wedding and Event Décor Agreement;
-
Rental Agreement;
-
Booking, Cancellation and Rescheduling Policy;

Event Operations and Venue Requirements;
-
Rental Equipment and Special Effects Terms;
-
Additional Fee Schedule; and
-
Written change orders or other booking documents accepted by the Client and Sapphire Sky Events.
If these Website Terms conflict with a signed client agreement or accepted booking document, the signed client agreement or accepted booking document will control with respect to the booked services.
2. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to submit a booking request, request a proposal, reserve services, or make a payment.
If you use the Website on behalf of another person, business, organization, venue, planner, or client, you represent that you have authority to act on that party’s behalf.
Individuals under 18 may browse the Website only with the supervision of a parent or legal guardian.
3. Website Information Is Not a Binding Offer
Information displayed on the Website is provided for general informational and promotional purposes.
Website content, including package descriptions, starting prices, examples, photographs, videos, dimensions, quantities, colors, floral selections, inventories, service areas, availability, timelines, and estimated pricing, does not constitute a binding offer or guarantee.
A binding booking exists only after all booking requirements identified by Sapphire Sky Events have been completed, which may include:

Approval of a final proposal;

Acceptance or signature of the applicable agreement;

Payment of the required booking payment;

Confirmation of availability; and
-
Written booking confirmation from Sapphire Sky Events.
Submitting an inquiry, requesting a consultation, receiving an automated response, discussing an event, or receiving a preliminary estimate does not reserve an event date or rental inventory.
4. Pricing, Packages and Availability
Prices displayed on the Website may be starting prices, estimated prices, package examples, or promotional prices.
Final pricing may vary based on factors including:

Venue access;

Quantities;
-
Guest and table counts;

Floral selections;
-
Installation requirements;
-
Labor;

Transportation;

Delivery distance;

Setup and breakdown times;

Rental duration;

Additional services selected by the Client.
Website prices and package details may be corrected or updated at any time before a binding proposal is accepted.
Display of an item or service does not guarantee that it is available for a particular event date. Inventory and personnel are subject to prior bookings and confirmation.
5. Inspiration Images and Portfolio Content
Photographs, videos, mood-board examples, styled shoots, renderings, previous-event images, and portfolio content are intended to demonstrate general style, quality, experience, and design possibilities.
They do not guarantee that another event will be reproduced exactly.
Final designs may vary because of inventory, venue dimensions, lighting, seasonal availability, flower variation, safety requirements, client selections, event budgets, supplier availability, photography, screen settings, and professional design judgment.
Any specific design obligations will be determined by the applicable signed proposal, approved design documents, and client agreement.
6. Inquiry Forms and Information Submitted by Users
You agree to provide accurate, current, and complete information when submitting an inquiry, requesting a consultation, completing a questionnaire, or communicating through the Website.
You should not submit:

False or misleading information;

Confidential information belonging to another person without permission;

Payment-card information through ordinary contact forms;

Social Security numbers;

Medical records;
-
Government identification documents;
-
Malicious files or code; or
-
Content that violates another party’s rights.
Submitting an inquiry authorizes Sapphire Sky Events to use the information provided to review the request, contact you, prepare an estimate or proposal, coordinate services, and respond to your questions.
Submitting an inquiry does not obligate Sapphire Sky Events to accept the event or provide services.
7. User-Provided Images and Materials
You may provide inspiration photographs, floor plans, venue diagrams, logos, names, wording, designs, or other materials for purposes related to an inquiry or booked event.
You retain any ownership rights you lawfully hold in those materials.
By submitting them, you grant Sapphire Sky Events a limited, nonexclusive permission to review, store, reproduce, share with necessary team members or service providers, and use them solely to evaluate the inquiry, prepare a proposal, plan the event, or provide the requested services.
You represent that you have the right to provide the submitted materials for those purposes.
Submission of inspiration material does not transfer ownership of third-party intellectual property to Sapphire Sky Events and does not guarantee exact replication.
8. Intellectual Property Rights
Unless otherwise stated, the Website and its original content—including text, graphics, branding, logos, page designs, layouts, videos, photographs owned or licensed by Sapphire Sky Events, proposal language, package descriptions, and other materials—are owned by or licensed to Sapphire Sky Events and are protected by applicable intellectual-property laws.
You may view and use the Website for personal, noncommercial purposes related to evaluating or requesting Sapphire Sky Events’ services.
Without prior written permission, you may not:

Copy or republish substantial Website content;

Download or reproduce portfolio images for commercial use;

Remove watermarks or ownership notices;

Modify or create derivative versions of Website content;

Use Website images to advertise another business;

Nothing in these Terms transfers any ownership rights to you.
9. Third-Party Photographs and Content
Certain photographs, videos, music, graphics, reviews, venue images, platform features, or other content may belong to photographers, videographers, clients, venues, vendors, social-media platforms, or other third parties.
Sapphire Sky Events does not claim ownership of third-party content merely because it appears on the Website.
You may not assume that Website access grants permission to copy or use third-party content. Permission should be obtained from the applicable rights holder.
10. Prohibited Website Conduct
You may not use the Website to:

Violate any applicable law;

Commit fraud or impersonate another person;

Interfere with the Website’s operation or security;

Introduce malware, viruses, harmful code, or automated attacks;

The Website may link to or integrate with third-party services, including client-management platforms, rental-booking systems, payment processors, scheduling systems, maps, analytics services, social-media platforms, video services, and vendor websites.
Third-party platforms operate under their own terms, privacy practices, availability, security, and technical requirements.
Sapphire Sky Events does not control and is not responsible for third-party websites or platforms, except to the extent responsibility cannot legally be excluded.
A link does not necessarily constitute an endorsement, partnership, sponsorship, or guarantee.
You should review the terms and privacy policies of third-party services before using them or providing information.
12. Payments and Online Transactions
Any payment or transaction initiated through the Website or a linked platform remains subject to:

Invoice;

Signed agreement;

Payment schedule;

Refund and cancellation terms;

Payment-processor rules; and

Any disclosures shown before payment.
Website Terms do not replace the payment, cancellation, rental, or refund terms contained in the applicable client agreement.
You are responsible for confirming that payment information is accurate and that you are authorized to use the selected payment method.
13. Communications
When you provide contact information through the Website, you authorize Sapphire Sky Events to contact you regarding your inquiry, consultation, proposal, booking, payment, event, or requested services.
Service-related communications may include email, telephone calls, text messages, client-portal messages, or other communication methods you use with us.
Promotional communications will be handled in accordance with applicable law and the consent provided. You may unsubscribe from promotional email or text messages using the instructions included in the communication.
Opting out of promotional communications does not prevent Sapphire Sky Events from sending necessary transactional or service-related communications concerning an active inquiry or booking.
14. Privacy
Use of personal information submitted through the Website is governed by the Sapphire Sky Events Privacy Policy.
The Privacy Policy explains the categories of information we collect, how information is used, service providers that may receive information, cookies and analytics, information-security practices, retention, and available privacy choices.
The Privacy Policy is separate from these Website Terms.
15. Reviews, Testimonials and Results
Reviews, testimonials, photographs, and event examples reflect individual experiences and particular events.
They do not guarantee that every client will receive identical results, designs, prices, venue conditions, timelines, or experiences.
Sapphire Sky Events does not knowingly publish fabricated testimonials. Testimonials may be edited for spelling, grammar, length, or clarity, provided the edit does not materially change the reviewer’s stated experience.
16. Website Availability and Accuracy
We make reasonable efforts to maintain useful and accurate Website content. However, the Website may contain typographical errors, outdated information, unavailable items, broken links, technical interruptions, or other inaccuracies.
We may modify, suspend, remove, correct, or discontinue Website content or features without prior notice.
We do not guarantee that the Website will always be uninterrupted, secure, error-free, compatible with every device, or free of harmful components.
You are responsible for maintaining appropriate device security, backups, and software protection.
17. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Website is provided on an “as is” and “as available” basis.
Sapphire Sky Events disclaims warranties relating solely to Website access and use, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, to the extent such warranties may legally be disclaimed.
This Website disclaimer does not eliminate any express obligation contained in a signed client agreement and does not limit rights that cannot lawfully be waived.
18. Limitation of Liability for Website Use
To the fullest extent permitted by law, Sapphire Sky Events and its owners, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to access the Website.
This includes loss caused by Website interruptions, third-party links, malware introduced by third parties, reliance on general Website information, unauthorized access not caused by the Company’s legally actionable conduct, or loss of Website data.
To the fullest extent permitted by law, Sapphire Sky Events’ total liability for a claim arising solely from use of the Website will not exceed one hundred dollars ($100).
This limitation does not govern liability arising from booked event services. Liability relating to booked services is governed by the applicable signed agreement.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability resulting from gross negligence, willful misconduct, intentional wrongdoing, or any nonwaivable legal obligation.
19. Indemnification for Website Misuse
You agree to indemnify and hold harmless Sapphire Sky Events and its owners, employees, contractors, and representatives from third-party claims, losses, liabilities, and reasonable expenses to the extent caused by:

Your unlawful misuse of the Website;

Your material violation of these Terms;

Content you submit without required permission;

Your infringement of another party’s intellectual-property, privacy, or publicity rights;

Fraud or impersonation by you; or

Malicious interference with the Website or its systems.
This obligation does not apply to the extent a claim was caused by Sapphire Sky Events’ gross negligence, willful misconduct, or violation of a nonwaivable legal duty.
20. Reporting Intellectual-Property Concerns
A person who believes that content on the Website infringes their copyright, trademark, or other intellectual-property rights may contact Sapphire Sky Events in writing.

Before filing a lawsuit arising solely from Website use, the parties agree to provide written notice of the dispute and make a good-faith attempt to resolve it informally.
Any legal proceeding arising solely from these Terms or Website use must be brought in a court of competent jurisdiction located in the State of Georgia, unless applicable law requires another location.
This section does not replace the governing-law, mediation, venue, or dispute provisions contained in a signed client agreement.
22. Changes to These Terms
We may update these Terms to reflect changes to the Website, business operations, technology, or applicable legal requirements.
Updated Terms will be posted with a revised “Last Updated” date.
Changes apply prospectively from the date they are posted and do not retroactively alter a signed client agreement or an already accepted booking document.
Continued use of the Website after updated Terms become effective constitutes acceptance of the updated Website Terms.
23. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.
24. No Waiver
Failure by Sapphire Sky Events to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision later.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Sapphire Sky Events.
Sapphire Sky Events may assign these Terms in connection with a merger, reorganization, sale of business assets, transfer of Website operations, or similar business transaction, subject to applicable law.
26. Entire Website Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sapphire Sky Events concerning general use of the Website.
They do not replace any signed proposal, invoice, client agreement, rental agreement, policy exhibit, or written change order governing event services.
